Terms of Service

These Terms of Service ("Terms") apply to the AI Landscape Design website at ai-landscape-design.com and the services offered on it (the "Service"). The Service is operated by Skyble Lab Inc. ("we", "us", "our"). Please read them before you use the Service. Our Privacy Policy explains how we handle your information.

1. Accepting these Terms

By creating an account, buying credits or using the Service in any other way, you agree to these Terms. If you do not agree, do not use the Service.

We may update these Terms from time to time. When we make a material change we will update the date at the top of this page and, where the change affects paid users, tell you by email or in the Service. If you keep using the Service after a change takes effect, you accept the updated Terms.

2. Who can use the Service

You must be at least 18 years old, or the age of majority where you live, to create an account or make a purchase. If you use the Service for a business, you confirm that you are allowed to accept these Terms for that business.

3. What the Service does

AI Landscape Design turns a photo of your outdoor space into AI-generated concept images. You upload a photo of a backyard, front yard, garden, patio or similar space, choose a style or describe what you want, and the Service returns a redesigned image of the same space.

Designs are concept images only. They are not measured plans, construction drawings, engineering or planting plans, cost estimates or professional advice. Results can be inaccurate: plants may not suit your climate or soil, sizes and quantities may be wrong, and features shown may not be buildable or allowed where you live. Check every design with a qualified landscaper, contractor or local authority before you buy materials or start work.

We may add, change or remove features, styles and quality options, and we may suspend the Service for maintenance or for reasons outside our control.

4. Your account

You sign in with Google or with a link sent to your email address. You are responsible for keeping access to that Google account or mailbox secure and for everything that happens under your account. Tell us at once at hello@skyblelab.ai if you think someone else has used it.

One person per account. Do not share, sell or transfer your account, and do not create multiple accounts to collect extra free credits.

5. Credits, packs and Pro plans

Credits. Designs are paid for with credits. A Basic design costs 1 credit and a Pro design costs 4 credits; the current cost is shown before you generate. If a design fails because of an error on our side, the credits for it are returned to your balance.

Free credits. New accounts may receive a small number of free credits. Free designs carry a small AI Landscape Design logo and may have fewer styles. We may change or end the free offer at any time.

Credit packs. Packs are one-time purchases. Credits bought in a pack do not expire while your account is open.

Pro plans. Pro plans are subscriptions billed monthly or yearly in advance and renew automatically until you cancel. Each plan includes a set number of credits per month; credits included with a plan are available for that billing period and do not roll over. You can cancel any time from your account settings; you keep your plan until the end of the period you have paid for, and you will not be charged again.

Prices and payment. Prices are shown on our pricing page and at checkout, and may include or exclude taxes depending on where you live. Payments are processed by Stripe; we do not see or store your full card number. We may change prices for future purchases and renewals; a price change for a subscription takes effect at your next renewal after we have told you about it.

Refunds. Because credits can be used immediately, purchases are non-refundable except where the law requires otherwise or where we decide to make an exception. If you think you were charged in error, contact us within 14 days at hello@skyblelab.ai and we will look into it.

6. Your photos and your designs

Your photos. You keep all rights to the photos and text you upload ("Your Content"). You confirm that you own Your Content or have permission to use it, and that it does not break anyone else's rights. You give us a limited licence to store, process and display Your Content only to run the Service for you, including sending it to the AI providers that generate your designs.

Your designs. As between you and us, you may use the designs you create for any lawful purpose. Designs made on a free credit carry our logo and are for personal use. Designs made with purchased credits or a Pro plan may be used commercially, for example in client proposals. Because designs are made by AI, similar images may be produced for other users, and we cannot promise that a design is unique or that it can be protected by copyright.

Showing designs. We do not use Your Content or your designs in our marketing without your permission.

7. Acceptable use

When you use the Service you must not:

• upload photos of places you have no right to photograph, or photos containing other people's private information, without permission;
• upload or try to generate sexual, violent, hateful, illegal or deceptive content, including images meant to mislead buyers, tenants or insurers about a real property;
• infringe anyone's copyright, trademark, privacy or other rights;
• try to get around credit limits, free-credit rules, watermarks or payment;
• copy, scrape, resell or build a competing service from the Service or its output, or access it with bots except through features we provide;
• probe, attack, overload or interfere with the Service or its security.

We may block a prompt or image, remove content and suspend or close an account that breaks these rules.

8. Our content

The Service, including its software, design, text, example images, styles and the AI Landscape Design name and logo, belongs to us or our licensors and is protected by law. These Terms do not give you any right to use our name, logo or materials except as needed to use the Service.

9. Disclaimers

The Service and all designs are provided "as is" and "as available". To the extent the law allows, we make no promises that the Service will be uninterrupted or error-free, that designs will be accurate, realistic, suitable for your property, buildable or legal where you live, or that they will meet your expectations. You are responsible for decisions you make based on a design.

10. Limitation of liability

To the extent the law allows, we are not liable for indirect, incidental, special or consequential losses, or for lost profits, data or property value, arising from your use of the Service or any design. Our total liability for any claim about the Service is limited to the amount you paid us in the 12 months before the claim, or US$50 if that is greater.

Nothing in these Terms limits liability that cannot be limited by law, or your rights as a consumer under the law of the place where you live.

11. Indemnity

If you use the Service for a business or break these Terms, you agree to cover our reasonable costs and losses from claims by others that arise from Your Content or from your breach of these Terms.

12. Ending your use

You can stop using the Service at any time and ask us to delete your account by emailing hello@skyblelab.ai. We may suspend or close your account if you break these Terms, if we are required to by law, or if we stop offering the Service. If we close the Service for reasons other than your breach, we will refund unused purchased credits on a pro-rata basis.

Sections 6 to 11 and 13 continue to apply after your account is closed.

13. Governing law and disputes

These Terms are governed by the laws of the State of California, USA, without regard to its conflict-of-law rules. Please contact us first so we can try to resolve any problem informally. If we cannot, disputes will be decided by the state or federal courts located in California, unless the law of the place where you live gives you the right to bring a claim in your local courts.

14. General

If any part of these Terms cannot be enforced, the rest still applies. If we do not enforce a right, we have not given it up. You may not transfer your rights under these Terms; we may transfer ours as part of a sale or reorganisation of our business. These Terms and the Privacy Policy are the whole agreement between you and us about the Service.
